You are the customer who has purchased from our website (“You” , “Your” , “Customer”, Visitor and/or “Purchaser”).

Access to and use of this Website and the products are subject to the following terms, conditions and notices. By using our website, you are agreeing to all of the Terms of Service, as may be updated by us from time to time. You should check this page regularly to take notice of any changes we may have made to our terms and conditions.

Terms of Sale

By placing an order with Cats got the cream you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.

Please read these Terms carefully and make sure that you understand them before ordering any Items from the Sites. Please note that before placing an order you will be asked to agree to these Terms. By placing an order you confirm your acceptance of these Terms.

You should print a copy of these Terms or save them to your computer for future reference.

We amend these Terms from time to time. Every time you wish to order Items, please check these Terms to ensure you understand the terms which will apply at that time. These Terms were most recently updated on 20th Feburary 2016.

Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force majeure for which we will not be responsible.

In order to contract with Cats got the cream you must be aged 18 or over. You must have in your possession a valid credit, debit card or payment method such as Paypal issued by a bank acceptable to us. Cats got the cream retains the right to refuse any request made by you, and Cats got the cream reserves the right to close your Cats got the cream account at its sole discretion for any reason. If your order is accepted by us we will let you know by email. When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit, debit card or other payment method used to place your order and that there are sufficient funds to cover the cost of the goods. All prices advertised are subject to such changes. Please be aware that some of the goods sold through our Website may not be suitable for children under 18 years of age, so please take extra care when purchasing goods as gifts, for under 18’s.

a. Our Contract

i. When you place an order on our website, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your payment has been approved us and we have debited your credit, debit card or paypal.

b. Pricing and Availability

i. It is our intention to ensure that all  product details, descriptions and prices that are displayed on our Website are accurate, however errors can and / or may occur. If we find that an error in the price of any goods which you have ordered we will inform you of this as soon as possible. You will then be given the option of reconfirming your order with us at the correct price or you can also have the option to cancel it. If we are unable to contact you for any reason we will deem the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. In most cases Delivery costs will be charged in addition, the total cast will be shown at the checkout page of our website.

ii.The Service may contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to for-fill any orders that you may place based on information on the Service that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies.

c. Payment

i. Once we have recieved your order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorisation check has been completed.

The Contract Between Us and You

Our website has several pages and the majority are our shopping pages. These shopping pages will direct you from beginning to end so that you can place an order with us. We have built our order platform in such a way that enables you to check and amend any errors before you place your order with us.

It’s important that you spent some time to ensure the specifics of your order at each point of the order process and before paying, as you will not be able to make any changes to your order after this point.

Once you have paid for your order you will be sent an e-mail from us recognising your order. We then send you an email that confirms that the Items have been despatched.

Please kindly be aware all products sold by us are subject to availability. There is a lapse in the process from the time a customer places an order to the time when the order is processed by us, the product availability may change for some or all of the items in your shopping basket. If an Item becomes out of stock we will notify you as soon as possible and you will be refunded where we have already taken payment.

We reserve the right to refuse an order for any reason we seem fit. Examples could include but are not limited to the following: If the product(s) you have ordered become unavailable or are out of stock, if we are unable to obtain authorisation of payment, if there is an error in the product information including price or promotion or if we suspect fraudulent activity.

If we are unable to supply you with an Item in these circumstances we will inform you of this by e-mail. If you have already paid for the Items, we will refund you the full amount including any delivery costs charged as soon as possible.

Disclaimer of Liability

All of the material written and shown on this Website is provided to our visitor’s without any kind of guarantees, conditions or warranties as to its accuracy. Unless we clearly state to you, Cats got the cream, our content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of this Website or the Linked Sites and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise. This does not affect Cats Got the Cream”s liability for serious missconduct for any kind of fraudulent matter such as misrepresentation. Nor our liability for serious negligence causing personal injury or death, or any other liability which cannot be excluded or limited under applicable law.

Postage & Delivery of Goods

Cats got the cream outsource their postage to a variety of courier specialists. These include but are not limited to companies such as the Royal Mail, DPD, DHL, My Hermes and Spicer International. In most cases we will send items purchased by customers using a recorded and tracked service. If your order has not been delivered within 7 days of the order being placed it is your responsibility to let us know by email theteam@catsgotthecream.co.uk. We keep all tracking information for 1 month from when you place your order, therefore if you have not contacted us within this timeframe you will not receive a refund as we cannot track the parcel to see it returned. It is your responsibility to be available at the delivery address to receive your order. If you are not able to sign for your order on delivery the item will be taken to a local courier centre for you to collect. Some couirers may try to redeliver. This does not effect your statutory rights.

Entire Agreement

All the above Terms and conditions constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and Cats got the cream. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of Cats got the cream.
